Sarah Kirby had her son on her hip when he started attacking Molly Culshaw, 36, and knocked her to the floor. The mother of the two children then put the toddler in his pram and used it to throw the victim, who was lying on the floor, before pushing him out of the elevator. Then she went back to kicking, punching and hitting her helpless friend and hitting her with a piece of wood, apparently unaware that the doors were closed and the elevator was gone. The 36-year-old appeared in Liverpool Crown Court on Friday, April 29, where she was sentenced to 12 months in prison. At the time of the attack, Kirby was sentenced to a 13-month suspended sentence – imposed by the same judge – for racist assault on a taxi driver. Michael Bagley’s lawyer said he had made good progress on the mandate, but that the offense had a “devastating” effect on him. Kirby, from Alexander House, Sandy Road, Seaforth, pleaded guilty to assault by beating and admitting to violating the suspended sentence imposed on September 4, 2020. Prosecuting Iain Criddle told the court that the attack took place on May 18 last year, after Kirby and her friend, who lived in the same block, had spent three hours outside that afternoon drinking. They returned to the victim’s apartment and an argument ensued during which Kirby verbally abused her, although Miss Culshaw admitted that she “gave as much as she could”. Mr Criddle said: “The argument developed in a way that could not have happened if they had not been drinking that afternoon. At that point, they both left and entered the elevator and the attack took place “. “He included Mrs. Kirby punching, pulling her hair, kicking and hitting Miss Kalsow.” She said that in the middle of the attack she put her child in the stroller and pushed it over Miss Kalso, who was on the floor. Mr Crindle said: “While the child was outside the elevator and in the hallway, the accused continued to attack Miss Kalsow, who was still on the floor. “He did not seem to notice that the elevator doors were closed and returned to the ground floor because he intended to attack Miss Kalsow.” Mr Crindl said Kirby went out at one point to see where her child was and was “surprised she was no longer in the hallway – because the elevator had gone down at least three floors”. Kirby was arrested later and when interviewed she said she was drunk and had acted in self-defense. Mr Crindl said the injuries were “extremely low” and included redness and bruising to her eye and left arm and scratches. The court heard that the 36-year-old victim, Molly Culshaw, lives on the 14th floor of the tower building and now feels trapped as she is afraid of entering the elevator or is unaccompanied. In an impact statement last September, the victim said she now had to rely on her family and wanted to leave, as she was afraid to take the elevator or meet Kirby alone. The court heard that Kirby has 17 convictions for 33 previous offenses involving violence. Defendant Michael Bagley said her response to oversight from the previous proposal was positive, but acknowledged that she “just overreacts” when she is under stress and her reaction was disproportionate. He added that he had “a very harmful upbringing”. Judge Brandon told Kirby, who wept in her seat until the judge told her she was unable or unwilling to remain free from the insult, “you present yourself as completely unrepentant and sorry for anyone but yourself. “The court cannot conclude that you have a realistic prospect of recovery. “You had so many opportunities and nothing stopped you from offending.” Convict Brandon said: “You dragged your son in the pram over her while he was on the floor and left him unattended as you continued your aggressive behavior towards her. It was so fierce of the attack that you completely forgot about him and abandoned him, you did not tie him to the cart and left him in the corridor “. She told Kirby that she had used three weapons – her leg, the broken frame and the stroller. Judge Brandon told her that she had several opportunities, but “did not learn from your mistakes” and was fortunate not to face a more serious charge “given the violence you committed”. Kirby was sentenced to four months in prison for the attack, with eight months suspended pending activation. A ten-year restraining order was also imposed to keep her away from her victim.
